"MINNEAPOLIS (WCCO) — A jury of twelve has found Kim Potter, the former Brooklyn Center police officer who shot and killed Daunte Wright, guilty on counts of both first- and second-degree manslaughter.
Judge Regina Chu has ordered Potter, 49, to be taken into custody immediately. Records confirm that she has been transferred to the women’s prison in Shakopee."

"Throughout the trial the prosecution argued that Potter was acting reckless when she mistook her firearm for her Taser, trying to prove that Potter was not taking her environment or her training into consideration, and putting her police partners in danger when she discharged her gun.
The defense on the other hand painted a picture of a chaotic struggle, caused by Wright, and an officer who under stressful circumstances made an “action error”; believing she was doing one thing while in fact, doing something else.
The jury came to a decision on the second-degree manslaughter charge on Tuesday morning. After asking Judge Regina Chu that afternoon what would happen if they could not come to a consensus, the 12 members eventually did, deciding to convict Potter on the first-degree manslaughter charge on Thursday."

If we were in a sane administration, legislation could be introduced to protect the police when trying to disable someone trying to evade, especially while trying to escape in a vehicle. The vehicle is a deadly weapon and is often turned in an attempt to run over police or any convenient target - like children watching a parade.

The law exists (qualified immunity). The charge in this case was that Potter used unnecessary and excessive force, and so when Wright died, the officer was charged with Manslaughter. If there was no issue with the use of force, itself, and no issue with the level of force, then when Wright died, Potter would not have been charged. Case law says that the force must be necessary and reasonable in the circumstances, and what reasonable officers would have done in the same situation, knowing and believing what the officer did at the time. Issues with the use of force/level of force used can arise from violation of Department policy, State or Federal law, or the Constitution. And then there's the matter of interpretation.

Some places are rescinding qualified immunity statutes/laws.

From what I have read, in the last 20 years prior to this event, there were 15 other incidents of an officer mistakenly using their service weapon, vice taser. Only 5 of those officers were charged with a crime, and only 3 were convicted. Two of those convicted were also the only two whose victims were accidentally killed.

I truly feel bad for this officer, and I hope her sentence is not harsh. However, a 26 year veteran has no excuse as to how she made such a tragic error.

If I were a LEO I would be making plans to transition to another line of work.

Not one of these cases should have ever happened. The one common denominator is always an out of control thug resisting arrest. They are not scared as they claim, they are following the thug code which comes from prisions.

This verdict does not bode well for law enforcement. The case law used here does not include intent or malice. For negligence to be criminal, IMO, there should be an intent to do harm and the negligence should be egregious. Her quick bungled response contained neither.
Am I hard hearted for my lack of sympathy for those who wrestle away from police and flee? What is the state of parental upbringing if a culture is created in which evading arrest is of no concern as long as you get away, or a combination of bungled actions resulting in death causes the police officer to be found guilty of manslaughter and imprisoned without bail?
Is there a possibility that unrelated and unhealed wounds produced the joyous crowd holding up signs saying GUILTY?
If you cant tell a taser from a firearm least you are is incompetent, never heard anything like it, or am i in cross purposes and talking about something different.

State changes course in seeking guideline sentence for Kim Potter​

State prosecutors have changed their position on seeking an upward sentencing departure for Kimberly Potter, the ex-Brooklyn Center police officer who was convicted of manslaughter for fatally shooting Daunte Wright during an April 11, 2021 traffic stop.
In a filing submitted Tuesday, Attorney General Keith Ellison’s prosecution team requested Judge Regina Chu issue a presumptive sentence under Minnesota sentencing guidelines for Potter’s first-degree manslaughter conviction. The state had previously announced its intent to seek an upward sentencing departure based on aggravating factors.

Considering her gross incompetence, but coupled with her 26 years of distinguished service, I think the judge was very fair in the sentence.

Daunte Wright's girlfriend settles suit against Brooklyn Center for $350,000​

Alayna Albrecht-Payton was injured after former police officer Kim Potter shot Daunte Wright and their vehicle crashed.

"Daunte Wright's girlfriend, who was a passenger in the car he was driving when he was fatally shot by a Brooklyn Center police officer in 2021, will receive $350,000 to settle a lawsuit she filed against the city.
In a unanimous vote, the City Council approved a resolution Monday to pay Alayna Albrecht-Payton $130,000. Another $220,000 will come from the League of Minnesota Cities insurance trust.
"We find this to be a fair settlement," said Bob Bennett, an attorney representing Albrecht-Payton.
The settlement calls for Albrecht-Payton to drop any further claims against the city, former officer Kimberly Potter, police and other parties named in the lawsuit filed in July in Hennepin County District Court."

"Shortly after his death, the city passed the Daunte Wright and Kobe Dimock-Heisler Community Safety and Violence Prevention Act, promising sweeping changes to policing. For the most part, the demands in the act have yet to be implemented."

"A white former police officer convicted of manslaughter after mistaking her handgun for a Taser and fatally shooting Black motorist Daunte Wright in suburban Minneapolis in 2021 is set to be released from prison Monday.
Minnesota Department of Corrections spokesman Andy Skoogman announced Friday that former officer Kim Potter was to be released after serving about 16 months of her two-year sentence. He said the exact timing of her departure Monday from Minnesota Correctional Facility-Shakopee won't be disclosed for security reasons.
"Our criminal investigative analysts are working closely with law enforcement to monitor the situation to ensure Kim Potter, like all incarcerated persons, is safe as she leaves our facility," Skoogman said in a statement."
