    The facts of the case are clear: Ernest Perce, a young atheist in Pennsylvania, marched in a Halloween parade dressed as “Zombie Muhammad.” A Muslim, Talaag Elbayomy, grew enraged when he saw Perce’s costume, and began choking him while trying to pull off the fake beard that Perce had glued onto his face. Perce went to the police, and so did Elbayomy – the latter under the mistaken impression that it was illegal in the United States, as it is in many Muslim lands, to insult or mock the prophet of Islam. Elbayomy was mistaken, of course: it isn’t illegal to mock Muhammad in the United States, but it may be soon, courtesy Judge Mark Martin, who dismissed the case against Elbayomy.

    Martin claimed in a message trying to explain away his mishandling of the case that he dismissed the case for lack of evidence: “In short, I based my decision on the fact that the Commonwealth failed to prove to me beyond a reasonable doubt that the charge was just; I didn’t doubt that an incident occurred, but I was basically presented only with the victim’s version, the defendant’s version, and a very intact Styrofoam sign that the victim was wearing and claimed that the defendant had used to choke him. There were so many inconsistencies, that there was no way that I was going to find the defendant guilty.”

    Martin didn’t mention in his apologia that Perce was filming at the time Elbayomy attacked him, and the video evidence is quite clear. Nor did he mention that a police officer on the scene, Sgt. Bryan Curtis, backed up Perce’s version of events. Both the video and Curtis’s testimony give the lie to Martin’s claim that “I was basically presented only with the victim’s version, the defendant’s version, and a very intact Styrofoam sign that the victim was wearing and claimed that the defendant had used to choke him.”

    Nor did Martin mention that he lectured Perce at length about how his Halloween costume outraged Islamic sensitivities, concluding: “And what you’ve done is you’ve completely trashed their essence, their being. They find it very, very, very offensive. I am a Muslim. I find it very offensive…You are way outside your bounds of first amendment rights.” Martin later denied that he was a Muslim, and so when he told Perce that he was one, he may have been speaking conditionally, as in, “If I were a Muslim, I, too, would find it offensive.”

    However, despite the best efforts of the Organization of the Islamic Cooperation (OIC) and its increasingly compliant enablers in the Obama Administration, it is still not illegal to offend Muslims in the United States. In fact, it is only illegal to offend Muslims and Islam under Islamic law. In lecturing Perce at length about how he had “trashed” Muslims’ “essence” and then ignoring two important sources of evidence that proved the charge against Elbayomy, Martin was effectively enforcing Sharia in an American courtroom. For under Islamic law, Elbayomy would have been perfectly within his rights, and even to be commended, for choking Perce for mocking Muhammad. The only criticism that might have been leveled against him had this case been brought in Jeddah or Tehran was that he didn’t finish Perce off altogether.

    Pamela Geller interviewed Perce, who articulated the implications of the ruling: “Martin’s decision effectively says that Muslims do not have to learn to accept blasphemy against their religion without violence. Yet when you are a citizen of the USA, you accept our Constitution. Free speech is our foundation.”

    Indeed. With the OIC engaged in a years-long struggle to compel Western states to criminalize truthful speech about jihad and criticism of Islam under the guise of criminalizing “religious hatred,” Martin’s skewed and biased ruling is particularly ominous, especially insofar as it coincides with Sharia prohibitions on speaking ill of Muhammad, the Qur’an, and Islam.

    This is why it is urgent that Judge Martin be impeached and removed from his post. Islamic law has now been involved in court cases in twenty-three states, while the Muslim Brotherhood-linked Islamic Circle of North America (ICNA) has embarked on a three-million-dollar nationwide campaign to whitewash Sharia and convince Americans that it is entirely benign, nothing to be concerned about at all. Yet there is no form of Sharia that Islamic jurists have ever elaborated or that has ever been implemented anywhere in the Islamic world that does not restrict the freedom of speech and require infidels to adopt a posture of chastened silence toward Islamic supremacism and Qur’an-inspired violence. And now an American judge in an American courtroom has validated the proposition that non-Muslims must not criticize or mock Muhammad or Islam in any way by ignoring evidence and letting go unpunished an attack upon an American who was exercising his right to free expression in a way that offended Muslim sensibilities.

    Islamic supremacist groups in the U.S. such as ICNA and the Hamas-linked Council on American-Islamic Relations (CAIR) are fiercely resisting the anti-Sharia measures now being considered in twenty states, and it is easy to see why: they would effectively stop or at least put a strong brake upon efforts to bring elements of Sharia to this country. They would put an end to the demand that American businesses and educational institutions must change the way they operate in order to accommodate Islamic law and custom. But with judges like Mark Martin on the bench, ICNA, CAIR and other Muslim Brotherhood entities in the U.S. don’t need to worry: Martin is already Sharia-compliant, already eager to set aside American law in order to do their bidding.

    That’s why Mark Martin needs to be impeached, and soon. Freedom of speech and freedom of expression are our most fundamental bulwarks against tyranny. Americans who think that these freedoms cannot be encroached upon or eroded because we have the First Amendment are naïve. They’re already being encroached upon: Hillary Clinton recently held meetings with the OIC, the particulars of which have never been disclosed, to discuss strategies to implement the OIC’s campaign to restrict free speech in America. And it is only going to get worse, unless lovers of freedom take a stand now. Ernest Perce’s case is the case of every believer in freedom, whether or not one approves of his particular form of mockery.

    This is a travesty, a heinous crime, a monstrous defilement of decency! How dare this man manufacture and brazenly wear such a grotesque counterfeit, a false beard?



    And yes, the judge shoud be impeached, disbarred, fined, rebuked, counseled, reprimanded, given a stern talking to, and deported to some sharia-paradise. The muslim can go with him, even if he did fight for the honour of facial hair. So there....

    I listened to the judges admonishments driving from SoCal to NorCal.

    I'm sorry to see a lynch mob mentality here here on the RF. This account comports with what I heard the Judge speak.

    Last Halloween, an atheist named Ernest Perce dressed up as Zombie Muhammad and joined a parade in Pennsylvania that also included a Zombie Pope and Zombie Jesus. A Muslim man, Talaag Elbayomy, decided that this was so offensive to him that he had to take action; he claimed that he thought there were laws against offending him. According to the officer who responded to the incident, Elbayomy admitted to initiating physical contact with Perce and thus should be found guilty of the assault. Furthermore, the incident was caught on camera.
    So Elbayomy was convicted, right?
    He was not. Instead, Judge Mark Martin chastised the atheist in question for his misinterpretation and lack of understanding concerning Islam. He then found Elbayomy innocent of all charges, claiming that there was not enough in the way of evidence.
    There are several separate issues in this case that have been conflated in many of the write-ups about it, and, indeed, by the judge himself. In order of relative importance, I would say that the first is Perce’s understanding of Islam, the second is Elbayomy’s understanding of the law, the third is the perspective of Judge Martin, and last, but not least, is whether or not Elbayomy is guilty of a crime.

    For all of my knowledge of Islam, I had no idea what Perce was talking about when he claimed that the Quran says that Muhammad rose from the dead. He might be referring to the story of Muhammad’s “miraculous night journey.” Of course, whether or not Zombie Muhammad is an actual thing in the Quran does not matter at all. Just as I am not legally permitted to smash someone’s computer when they parade the tired stereotype that atheists are all amoral douchebags (pro-tip: it simply isn’t true), Elbayomy is not legally allowed to tear at someone’s costume while they are wearing it because they dressed up as something that is inaccurate to Islam.
    In the audio recording of the case, Elbayomy says that he thought it was against the law to dress up as Zombie Muhammad. Even if that sincerely were the case (which I would find bizarre given that many immigrants come to the U.S. because of things like freedom of speech), the man had no right to take the law into his own hands. Self-defense is only a legitimate defense if your bodily integrity is in question, not when you and your family are upset by something.
    In terms of the judge in this case, Perce’s title for his Youtube post of the audio for the case, as well as others’ articles, say that Mark Martin is highly sympathetic to Muslim causes. He admits as much in the audio, discussing a bevy of issues before issuing his decision, including his personal opinions of Perce, his views on how he feels the First Amendment should be used, the treatment of blasphemy in Muslim countries, and Perce’s lack of understanding of Islam and Muslims. He then claims to put all that aside before stating that there is not enough evidence to prove Elbayomy guilty.
    While the outcome of the case cannot be evaluated solely based on the judge’s views, the fact that he aired them is disturbing. As for the views themselves, they are irrelevant to the case and by stating them, the judge reveals his deep biases, no matter what he claims about putting them aside before issuing his decision. The idea that American law should be at all influenced by anti-free speech values is abhorrent.
    Furthermore, he, as an ally to the American Muslim community, has done it a great disservice. Already, people are claiming that this is an example of the implementation of sharia in the United States and necessitates anti-sharia legislation. It is now going to be far harder to argue that sharia is not the threat in the U.S., I have done so in the past, as Judge Martin’s comments are the first real example to which those who fear sharia can point and say, with some basis, that Islamic viewpoints are being favored over Constitutional ones.
    In the case of the final issue, i.e. the only truly relevant one for this case, you can decide for yourself, based on the video as well as the testimony of the officer who responded to the incident. According to Perce, physical contact took place; according to the officer, Elbayomy admitted to it. While I am inclined to say that I would take the testimony of two people, one of whom was not directly a part of the incident, over the testimony of a single person accused of assault, I, unlike Judge Martin, will freely admit that my biases influence my decisions: I have been the target of overzealous, offended Muslims enough times to where I would consider them capable of a lot of things when upset, assault being one of them.

    Somehow I would have expected this in California or NYC but NOT in Pennsylvania. If sharia takes hold we are all in trouble. I, for one, will begin a campaign of civil disobedience if it comes to my State. I will not follow it's precepts even in it's most unobtrusive forms.

    The Pennsylvania impeachment hysteria is the wrong horse to ride. We need to to focus our priorities taking first things first rather ginning up a lynch mob for some hick judge with a flair for drama.

    The Judge that should be impeached above all others is, Supreme Court Justice Ruth Bader Ginsburg. She took an oath to protect and defend the Constitution. She demonstrated she has broken her oath when she stated to the world her opinion of our Constitution:
